Ok,

I have a claim that my insurance paid to my builder and I. the total was $5557. less 500 deductible, so the check was $5057.

so, after said builder completing a portion of his work, I decided to go with a different company. so after the work he owes me money:

original estimate $5,557.05

Check issued $5,057.05

work performed - $2,067.05
==========================

difference to me $2,990.00

builder wants give me $2,490.00


the builder is still saying I owe him the deductible, even though my insurance co with held that portion from the total claim of $5,557.05 but I feel like I don't need to since my insurance company kept $500.



Can someone explain why i still owe a deductible?

no you don't owe him deductible. he is trying to make more money. you should only owe him the work performed which is the $2,067.05. if he tucked in the $500.00 deductible then make sure you have that listed on the itemized bill. You can then turnaround and show the bill to your lawyer.

do you have experience with insurance? the deductible is between me and my insurance company... not me and my builder. right?


i would owe the deductible (+ or - $$) if this builder completed the work and he performed all the work on the contract right? but the contract wasn't completed, so I'm cashing out.
